AETN Online Privacy and Usage Policy
Nothing is more important to us than protecting the private information of our visitors. From the AETN homepage to more than 85,000 pages of content produced by other PBS stations, the aetn.org domain remains a safe haven. All PBS affiliated web sites (including AETN and the AETN Foundation) adhere to a strict policy for ensuring the privacy of yourand your childrenspersonally identifiable information (such as full name, address, e-mail address, telephone number and/or other identifiable information) and preserving the integrity of this online medium.
Gathering and Use of Information
- AETN will not collect personally identifiable information from you, other than what you supply to us on a voluntary basis.
- In order to participate in some activities, you might be asked to provide some personally identifiable information. This could be in connection with the following:
- contest or sweepstakes registration
- subscription registration for services which require subscription (such as e-mail newsletters)
- requests for membership information for transactions in shop AETN
- content submissions, community postings (i.e., forums or bulletin boards), comments and suggestions, or voting
- AETN Online and other PBS affiliated Web Sites will not willfully disclose your personal information to any third party without first receiving your permission.
- AETN Online and other PBS affiliated Web Sites may use your personally identifiable information for activities explained above, for internal marketing and promotional purposes only.
- AETN will always explain the extent of its use at the time you are asked to provide personal information. If you do not want this information to be collected or used by us for these purposes, you can simply "opt out." Under certain circumstances, opting out may prevent your participation in activities for which personal information is needed, as in contests.
Rules of the Road
The following rules govern the use by you of AETN Online. Please make sure to read these rules to understand the additional terms and conditions that apply to your use of our sites. The rules set forth herein apply to all materials, online communications and other information that is or becomes available on AETN Online (collectively, "Information"). By signing on and using AETN Online, you specifically agree to abide by these rules and any modifications thereto.
- Personal Uses Permitted
AETN Online is an online information exchange service for use by AETN, the AETN Foundation, PBS, other PBS-affiliated stations and the general public. You shall not post, publish, transmit, reproduce, distribute or in any way use or exploit any Information for commercial purposes or otherwise use the Information in a manner that is inconsistent with these rules and regulations.
- User's Obligation to Abide By Applicable Law
In connection with the use of AETN Online, you shall abide by all applicable federal, state or local laws, including those pertaining to such areas as libel, slander, defamation, trade libel, product disparagement, harassment, invasion of privacy, tort, obscenity, indecency, and copyright or trademark infringement ("Applicable Law"). The Information available on AETN Online may include intellectual property that is protected under the copyright, trademark and other intellectual property laws of the United States and/or other countries ("Intellectual Property Laws"). Such Intellectual Property Laws generally prohibit the unauthorized reproduction, distribution or exhibition of all text, photographic and graphic (art and electronic) images, music, sound samplings and other protected materials. The violation of applicable Intellectual Property Laws may give rise to civil and/or criminal penalties.
- Disclosure of Online Communications.
You are cautioned that any online communications may not be fully confidential. In addition, you should be aware that federal postal regulations do not protect electronic mail. You should be aware that some administrative personnel of AETN might, in the course of their regular duties, have access to communications for technical or operational purposes. AETN may also disclose any communications to the extent permitted or required by law.
- Prohibition Against Rogue Programming
You shall not post, transmit or make available in any way through AETN Online any software or other materials which contain a computer virus, Trojan horse, time bomb, worm or other rogue programming ("Rogue Programming"). AETN has no obligation to detect the presence of any Rogue Programming. Any downloading of software or other materials or any other use of the Information on AETN Online is at your risk, and you are advised to take adequate precautions to minimize any loss to your system caused by Rogue Programming, including use of anti-virus programs and proper backup of files.
- Content of Information
You are responsible for the content of any Information you put on AETN Online. AETN has no obligation to, and does not in the normal course, monitor or control any Information that is or becomes available on AETN Online. AETN reserves the right to review any Information that is or becomes available on AETN Online. AETN reserves the right to refuse to post or to remove any Information that is, in AETN's sole discretion, unacceptable, undesirable or in violation of these rules. However, AETN has no obligation to exercise such reservation of rights by AETN.
- Disclaimer of Warranties
AETN Online is provided on an as is basis without warranties of any kind, either expressed or implied, including without limitation warranties of title, non-infringement, or implied warranties of merchantability or fitness for a particular purpose. Neither AETN, the AETN Foundation, PBS nor PBS affiliated stations warrant that any information is complete or accurate or that AETN Online will be uninterrupted or error free or that any Information is free of Rogue Programming.
- Limitation of Damages
Under no circumstances, including negligence, shall AETN, the AETN Foundation, PBS or any PBS affiliated station be liable for any direct, indirect, incidental, special, punitive or consequential damages that may result form the use or inability to use AETN Online, including without limitation use of or reliance on Information available on AETN Online, interruptions, errors, defects, mistakes, omissions, deletions of files, delays in operation or transmission, non-delivery of Information, disclosure of communications, or any other failure of performance.
- Release and Indemnity
You hereby release and waive any and all claims and/or liability against AETN, the AETN Foundation, PBS or any PBS affiliated station arising from or in connection with your use of AETN Online. You also agree to defend, indentify and hold harmless, AETN, the AETN Foundation, PBS and any PBS affiliated station, from and against, any and all claims or liability, including costs and attorneys fees, arising from or in connection with your use of AETN Online or failure to abide by applicable law.
These rules may be modified by AETN from time to time and such modifications will be binding on you when placed online.

Terms and Conditions for Use of shop AETN
The Arkansas Educational Telecommunications Network Foundation (AETN Foundation) provides shopAETN (the "Service") on behalf of the Arkansas Educational Television Network (AETN) subject to your compliance with the terms and conditions below and subject to the AETN Online "Rules of the Road." These terms and conditions (this "Agreement") modify and supplement the "Rules of the Road" to the extent you use the Service.
Please read this Agreement carefully before accessing the Service. By accessing the Service, you agree to be bound by the terms and conditions below. If you do not wish to be bound by these terms and conditions, you may not access or use the Service.
- Use of the Service
You assume total responsibility and risk for your use of the Service and the Internet. It is solely your responsibility to evaluate the accuracy, completeness and usefulness of all opinions, advice, services and other information, and the quality and merchantability of all merchandise, provided through the Service. You understand that, except for information, products or services clearly identified as being supplied by AETN, all merchandise, information and services offered or made available or accessible through the Service are offered or made available or accessible by third parties who are not affiliated with AETN. If you are dissatisfied with the Service or with any terms, conditions, rules, policies, guidelines, or practices of AETN in operating the Service, your sole and exclusive remedy is to discontinue using the Service.
- No Service Warranties
The Service is provided on an as is and as available basis without warranties of any kind, either expressed or implied, including but not limited to warranties of title, non-infringement or implied warranties of merchantability or fitness for a particular purpose. No advice or information given by PBS, AETN or its agents, contractors or their respective employees shall create a warranty. AETN does not warrant that the Service will be uninterrupted or error free. AETN does not warrant that the Service will appear as intended due to the various versions of Web browsers used on the Internet. Under no circumstances shall AETN, its agents, or contractors be liable for any direct, indirect, incidental, special, punitive or consequential damages that result in any way from your use of or inability to use the Service or to access the Internet or any part thereof, or your reliance on or use of information, services or merchandise provided on or through the Service, or that result from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation, or transmission, or any failure of performance.
- Making Purchases On the Service
If you wish to make purchases on the Service, you may be asked to supply certain information, including credit card or other payment mechanism information. You agree that all information you provide for purposes of making purchases will be accurate, complete and current. AETN and other service providers offering merchandise, information and services on the Service set their own prices and may change prices or institute new prices at any time. You agree to pay all charges incurred by users of your account and credit card or other payment mechanism at the prices in effect when such charges are incurred. You also will be responsible for paying any applicable taxes and shipping/handling relating to purchases on the Service.
- Failure to Comply With Terms and Conditions
AETN may deny you access to all or part of the Service without notice if you engage in any conduct or activities that AETN in its sole discretion believes violates any of the terms and conditions in this Agreement. If AETN denies you access to the Service because of such a violation, you shall have no right
- to access through AETN any materials stored on the Internet,
- to obtain any credit(s) otherwise due to you, and such credit(s) will be forfeited,
- to access third party services, merchandise or information on the Internet through AETN, and AETN shall have no responsibility to notify any third-party providers of services, merchandise or information nor any responsibility for any consequences resulting from lack of notification.
You agree to defend, indentify and hold AETN, the AETN Foundation, PBS and any PBS affiliated station harmless from any and all liabilities, costs and expenses, including reasonable attorneys' fees, related to any violation of this agreement by you or authorized users of your account, or in connection with the use of the service or the Internet or the placement or transmission of any message, information, software or other materials on the Internet by you or authorized users of your account.
In the event that any portion of this agreement is held to be unenforceable, the unenforceable portion shall be construed in accordance with applicable law as nearly as possible to reflect the original intentions of the parties and the remainder of the provisions shall remain in full force and effect.
AETN's failure to insist upon or enforce strict performance of any provision of this agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between parties nor trade practice shall act to modify any provision of this Agreement.
AETN may modify this Agreement from time to time by placing a notice of such modification on AETN Online and your continued use of the Service following notice of such modification shall be deemed to be your acceptance of any such modification. If you do not agree to any modification of this Agreement, you must stop using the Service.
This Agreement shall be governed by and construed in accordance with the laws of the State of Arkansas, without regard to its conflicts of law provisions. Any cause of action you may have with respect to the Service must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is barred.
This Agreement constitutes the entire agreement between you and AETN with respect to the Service.
For Parents and Caregivers of PBS Kids
You have trusted AETN for many years to provide responsible and quality content for children. As we move into the cyberspace world, this trust becomes even more important to you, and to us. We believe the following promises will improve the safety, value, and enjoyment of your child's visits to our site and our affiliated sites.
We will not collect personally identifiable information from your child.
If your child sends us an e-mail with a question or comment, or enters one of our contests, we may respond using his or her e-mail, but will not store it for future communications.
If we know that your child is under the age of thirteen, we will collect your permission offline (by postal mail, fax or phone) before we mail any prizes or share your child's personal information with anyone else.
If your child submits artwork, stories, comments or anything else to us that are posted at our site, he or she will be identified only by first name, age and city.
We also promise to help children, their families and communities find the information they need to use the Internet safely and responsibly.
You and your child's use of this site are conditioned on your having accepted these terms. You should check back at this policy frequently, since it is subject to change from time to time, and your continued use of the site is conditioned upon your acceptance of any modifications hereto.
We want to make this site a place where families can surf together, and where parents and caregivers are happy to have their children interact, learn and play. If you have any comments or questions, we're happy to hear them. This is, after all, your site.
